Terms of Use for Snagoo
Upon registration with www.snagoo.com you accept, understand and agree to the terms and conditions as displayed below. Snagoo reserves the right to make changes to the terms and conditions at any time, at its own discretion without any prior notice. Snagoo will do its best to notify users of any changes to the terms and conditions, however members of Snagoo should check the terms and conditions regularly in order to keep up-to-date with any changes. All changes will be published in this section of the website. If you do not agree with any of the terms and conditions as set out below, you should discontinue use of the service.
The Service
Snagoo's Lowest Unique Bid Auction is a reverse auction service where it is the lowest unique bid that wins. The lowest unique bid is defined as the lowest bid amount in a particular auction where only one bidder has bid that amount. Each auction is time-based, with a clock available on the auction page that displays the time remaining before the close of the auction. The winning bidder is the bidder that holds the lowest unique bid at the close of the auction. If there is no lowest unique bid at the close of an auction, the winner will be determined by the lowest bid amount with only two bids and the member that placed the bid first, and so on, until a winner is discovered. All Lowest Unique Bid Auctions, therefore, will have a winner at the close of the auction.
Obtaining Bids and Credits
Snagoo members will automatically have 5 Available Bids every day that they log in to Snagoo. Bids that are placed in an auction will remain active for that auction until the auction ends. Any Available Bids that are not placed in an auction will expire at the end of the day. Each day, the Available Bids will be reset to 5 Available Bids.
Members can obtain more daily Available Bids by becoming Premium Members. Premium Members receive 15 Available Bids each day they log in to Snagoo. Premium Membership is available to members for free by participating in an offer using TrialPay, or for purchase through PayPal. Members and Premium Members can also obtain BidBursts to get more Available Bids. BidBursts are packages of bids that can be stored until converted to Available Bids. BidBursts that have not been converted to Available Bids have no cash value, cannot be traded, and do not expire. Upon converting the BidBurst to Available Bids, the BidBurst is no longer available, and the Available Bids must be used in the same day they become available or they will expire.
Membership
By joining Snagoo, you agree that you are over 18 years of age and legally reside in the United States. Snagoo is open to residents of the United States only. By registering an account with Snagoo, members agree that they are legally permitted to participate in a reverse auction in the location at the time of placing a bid. Any jurisdiction that may prohibit members from participating in reverse auctions is the responsibility of the member and no responsibility will be held by Snagoo. Each member may only hold one account with Snagoo. If a member is discovered to have more than one account, Snagoo reserves the right to cancel one or all of that particular member's accounts upon which they will immediately forfeit any bids or purchase opportunities associated with that particular member's accounts. Snagoo may also cancel a member's account if they are deemed to have provided Snagoo with any false or misleading information when becoming a member or purchasing Snagoo Creditsor Items, used a fraudulent credit card to purchase Items, or a member breaches any of the terms and conditions set out in this agreement.
Website Currency
All prices on Snagoo are displayed in US Dollars. This will be used as the standard currency for the value price shown for the Items in each auction.
Sharing Bid Information
A member must not disclose their Bid Amount in a particular auction to any other person before the close of that particular auction. Snagoo may cancel a member's account if they are deemed to be colluding with another member, bidding from multiple accounts established by themselves or others or other fraudulent activity is suspected. By placing a bid in a Snagoo auction, you agree that the cost of the bids is non-refundable and that you may not cancel or change a bid once it has been submitted in an auction.
Publicity
As a member of Snagoo, you agree that your username, first name, state of residency or image may be used in promotional materials produced by Snagoo and displayed on the Snagoo winners page. Snagoo will never use your full name, last name or initial, street address or any other contact details in promotional material or throughout the website. If you wish to be removed from any promotional material please email support@snagoo.com .
Cancellation of Auctions
Snagoo's Lowest Unique auctions may be cancelled if deemed necessary by Snagoo. It is Snagoo's intention to allow all auctions to continue until completion, however, in certain cases it may be deemed necessary to cancel an auction. This may be due to an item no longer being available, fraudulent bidding activity, system malfunctions, or any other reason. Snagoo assumes no liability in the event an auction is cancelled. A bidder in an auction on Snagoo has no right to the product unless the auction is completed and that bidder is determined to be the winner, and that winner has not violated any of the Terms of Use on Snagoo.
Referrals
Current members will automatically have a Referral Link available to them in their "My Snagoo" section. A "Referrer" is a user that makes this Referral Link available to others to click on or directs others to this URL. A "Referred User" is a person that clicks on the Referral Link and visits Snagoo for the first time, and then becomes a member. When Referred Users click on this Referral Link and then become members, the Referrer will get credit for that referral. Referral credit is associated to the Referrer permanently (for life). Any time the Referred User becomes a Premium Member or renews Premium Membership this is called a "Referral Action." For every Referral Action the Referrer will earn a BidBurst. If the Referrer is a Premium Member at the time the Referral Action occurs, the Referrer will also earn Cash Awards, as identified in the "Cash Awards" section of "My Snagoo" for Premium Members. Referrers who are not Premium Members at the time of the Referral Action are not eligible for a Cash Award for that Referral Action, but are still awarded a BidBurst. For the current award value of BidBursts to Referrers and the current Cash Awards for Premium Members who generate Referral Actions, please see the applicable pages in the "My Snagoo" section.
Privacy
Snagoo will not willfully share any information about any user with any third party, except where previously noted such as the display of Usernames, etc in the context of the auctions. Snagoo does not sell, rent, or otherwise intentionally disseminate any information about any user to any third party. However, in the event that a third party obtains any information about a Snagoo user without explicit permission from Snagoo or the user, Snagoo will not be held liable. Snagoo will take reasonable precautions in protecting the user's identity and information, such as requiring usernames and passwords to access the site, but assumes no blame in the event a user's information is accessed in a manner not intended by Snagoo.
